1. Platform Scope & Eligibility

2. Independent Discovery Engine & Third-Party Transactions
- Non-Seller Status: TourAndTunes does not hold ticket inventory, process credit card payments, issue physical or electronic barcodes, or set ticket prices.
- Ticketing Partner Terms: All ticket bookings, seat assignments, customer support, cancellations, postponements, and refund requests are governed exclusively by the terms and conditions of the specific ticketing partner you select (e.g. Ticketmaster, StubHub, TicketNetwork, viagogo).
- Price Fluctuations: Live entertainment ticket prices change dynamically in response to market supply and demand. TourAndTunes cannot guarantee that a specific price or seat tier viewed on our platform will remain available at the moment of checkout on the partner platform.
3. Intellectual Property & Nominative Fair Use
All proprietary branding, software code, logos, visual designs, and original editorial text on TourAndTunes.com are the exclusive intellectual property of TourAndTunes. Artist names, band trademarks, music genre names, venue titles, and festival designations are the property of their respective trademark holders and are utilized on TourAndTunes strictly for descriptive, nominative fair use to inform music fans about live entertainment events.
4. Acceptable Use Policy
When accessing or using TourAndTunes, you agree not to:
- Use automated scrapers, bots, spiders, or data mining software to extract event databases without express prior written consent.
- Engage in denial-of-service (DoS) attacks, flood requests, or attempt to compromise server infrastructure.

6. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall TourAndTunes, its officers, directors, employees, or partners be liable for any direct, indirect, punitive, incidental, special, or consequential damages resulting from:

- Event cancellations, artist lineup changes, weather postponements, or venue rescheduling.
- Disputes, delays, seat discrepancies, or non-delivery arising from transactions with third-party ticketing vendors.
7. Governing Law & Severability
These Terms shall be governed by and construed in accordance with the laws of your applicable regional jurisdiction, without regard to conflict of law principles. If any provision of these Terms is deemed unlawful or unenforceable, that provision shall be severable without affecting the enforceability of the remaining provisions.
